Terms and Conditions
§ 1 – Provider, Incorporation of the Terms and Conditions
(1)
The seller and contracting party for the goods offered in the “Slow German” shop is Larissa Vassilian, Watzmannstr. 25a, 85586 Poing, phone 08938888646, email podtourist@gmail.com (hereinafter referred to as the “Seller”).
(2)
These General Terms and Conditions form an integral part of every contractual agreement between the Provider and the respective Customer. Any conflicting terms and conditions of the Customer are hereby rejected.
§ 2 – Product Selection and Conclusion of Contract
(1)
The seller offers the digital products displayed in its "Slow German" shop for sale to users.
(2)
The selection of goods, the conclusion of the contract, and the fulfillment of the contract are conducted in German.
(3)
The customer selects the desired items by adding them to the “Shopping Cart.” The order can then be submitted to the seller. Until the order is submitted, the customer may at any time view and modify the information provided in the order or cancel the order entirely.
(4)
The seller makes a binding offer to sell the goods displayed in the seller’s online store. By submitting the order request, the buyer accepts the offer. The seller confirms the conclusion of the contract via email (contract confirmation).
§ 3 – Prices and Payment
(1)
All product prices are final. Prices include 19% sales tax.
(2)
The seller will ship the order, at the buyer’s discretion, either upon advance payment via bank transfer or upon advance payment via PayPal.
(3)
For orders paid in advance, payment must be made within one week of receipt of the order confirmation. It is the customer’s responsibility to ensure that payment is made in a timely manner so that it is received by the seller within the specified period.
§ 5 – Consumer Right of Withdrawal
(1)
A customer who purchases as a consumer is entitled to a right of withdrawal in accordance with the statutory provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed
professional activity.
(2)
The provider grants consumers who are permanently resident outside Germany a 14-day cancellation period even if the consumer’s national law provides for a shorter period.
(3)
The provider allows consumers whose permanent residence is outside Germany to submit their notice of withdrawal informally
even if the consumer’s national law requires a more formal procedure.
(4)
For consumers who are permanently resident in Switzerland, the conditions and legal consequences of the German consumer right of withdrawal apply even if Swiss law does not provide for such a right of withdrawal.
§ 6 – Warranty
The purchaser's warranty rights are governed by applicable law.
§ 7 – Privacy Notice
(1)
The provider processes the data referred to in paragraph 1 electronically for the proper performance of the contract, in particular for invoicing and recording payments.
(2)
The provider will retain the data until all mutual claims arising from the order have been fully settled and the provider’s retention obligations under commercial and tax law have expired.
(3)
The customer may at any time request information from the provider regarding the data the provider has stored about the customer. Furthermore, the customer may at any time request the correction of inaccurate data.
(4)
The entity responsible for data protection is the provider named in § 1, paragraph 1.
(5)
If the customer uses PayPal for payment, the PayPal Privacy Policy applies in addition to these terms and conditions. In this context, PayPal acts as an agent of the customer, not of the provider.
Section 8 – Final Provisions
(1)
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. However, German law does not apply to consumers who are permanently resident abroad to the extent that the consumer’s national law contains provisions from which it is not possible to deviate by contract to the detriment of the consumer.
(2)
Should any provision of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
